An ROTC instructor from Henley High School in Klamath Falls accused of sexually abusing a 17 year old female student is out of jail after posting bail.
Police say 63 year old Kenneth Norman Gardner became the subject of an investigation after a suggestive text message was intercepted by the mother of the victim.
Gardner faces charges including sexual abuse, official misconduct, and luring a minor.
"Mr. Gardner said that he would waive grand jury, which means that he's going to admit that we have the authority to charge him with what we're going to charge him with." says Ed Caleb, Klamath County D.A.
Gardner said in court that he waived grand jury to spare the victim from any more trauma.
