Brockport, N.Y. -- (WHEC)  A bad joke or animal abuse?

That's the question about a photo that shows a man in a college t-shirt holding a dog, upside down, over a keg of beer at a house in the Village of Brockport, New York over the weekend. 

Now, police say they have arrested two College at Brockport students. 

Shane Oliver, 20, of Bergen, is charged with torturing an animal. It’s a misdemeanor. Police say Oliver is the student pictured holding the dog over the keg.

The other student arrested is Robert Yates, 20, of West Seneca. Police say he posted the picture on his Twitter page. Police say Yates shut down his Twitter account.

The College at Brockport did release a statement saying, "We were alarmed to learn of this disturbing photo. The College is investigating this matter and will take appropriate action once the details surrounding the photo are learned."

Police say the owner of the dog, whose identity will not be released, was not present during the incident or believed to have played any role in the incident.
