City of Phoenix ordering MMJ facility to close

Phoenix, Ore. --  City Manager, Steve Dahl said it's time for The Greenery, a medical marijuana patient facility to close it's doors.

"We have sent a registered letter asking them to voluntarily shut down by next week."

Back in March city councilors voted in favor of a moratorium, a temporary ban on medical marijuana dispensaries.

The Greenery does not consider itself a dispensary but a resource center for medical marijuana patients.

The executive director said, "If they are successful in closing the doors of The Greenery it means that they are restricting the safe access to medicine that is absolutely essential to our hundreds of thousands of patients in Southern Oregon."

But Dahl said The Greenery is breaking city code and operating without a business license.

If they don't close on their own he said they'll take it to court.

"We will have to take the next steps in shutting them down which could include going and getting an injunction against them."

"I'm not surprised that they sent it based on the actions of the city council and city management recently. And really in their entire conduct in dealing with the greenery," said Adams.

Adams continued and said she'll fight to keep doors open.

Phoenix's city officials have not decided if they will allow dispensaries at the end of the moratorium. But Dahl said they are considering it.
