Medford, Ore. -- A Seattle Washington man arrested for acting erratically at an Ashland Burger King parking lot with his daughter in the back seat was sentenced to either 90 days jail or house arrest and post prison supervision.

28 year-old Elijah Benbow changed his plea to guilty and sentenced for charges including possession of meth, driving under the influence, reckless endangering and causing substantial risk to a minor.

Bebow was originally accused of allowing his 6 year old daughter to consume methamphetamine, but later tests couldn't confirm it.
Benbow was sentenced to ninety days in jail unless he can prove that he has a job which he claimed to the judge he had.

Jackson County Circuit Court Judge Adam Peterson said he would reduce Benbow's sentence to house-arrest and 72 months probation plus the suspension of his drivers license if he could prove he had a job to go back to in Washington.
