“A cop completely out of control”

Albuquerque, N.M. — (KOB News) A 24-year-old University of New Mexico law school student says he was kneed in the groin by an Albuquerque Police Department officer so hard it shattered one of his testicles.

It was after midnight Friday. 24-year-old law student Jeremy Martin was driving a carload of friends through the UNM area when cops say he ran a stop sign.

According to the police report, APD Officer Padilla said Jeremy seemed drunk and admitted to having three beers. After a field sobriety test, Officer Padilla told Jeremy to sit on the curb but says Jeremy resisted.

Jeremy martin’s attorney, Sam Bregman says what happened next is hard to stomach.

“This officer felt the necessity to knee him so directly and with so much blunt force that it shattered his testicle,” Bregman said.

Jeremy was booked on DWI and marijuana possession charges–both misdemeanors.

In his mug shot, his face is badly scraped. The police report mentions those injuries, but nothing about how they happened, and nothing about the testicle.

“He was taken to Presbyterian Hospital where he had emergency surgery to have his testicle removed,” Bregman said.

Bregman is in the middle of filing a lawsuit against the officers involved, but most of all, an answer to this:

“How does a DWI investigation with a first year law student — when he absolutely did nothing to provoke the officer — result in the shattering of his testicle and emergency surgery to remove it” Bregman asked.

There are several confusing things about the police report filed by the officers who arrested Martin.

Not only is there no mention of the injury to Martin’s testicle, but the report also says he blew a stop sign while travelling north on Wellesley Place.

There is no way to travel northbound on Wellseley to the stop sign in question.
