Marijuana gifting

Klamath Falls, Ore. – It’s still illegal in Oregon to sell marijuana for recreational use…but some people are using what they see as a ‘legal loophole’ to skirt the law.

Recreational marijuana can’t be sold yet in Oregon, but it can be given away.

Medical marijuana dispensary owner Edward Medina explains:  “The only way to legally obtain cannabis without having a medical card is through gifting.”

But some card holders are giving medical marijuana away – then charging for the container, or a delivery fee.

“That is one way that people are getting around the legalities of selling cannabis.”  Notes Medina.

But Klamath County District Attorney and OLCC Chair Rob Patridge doesn’t think that loophole would hold up in court…

“You can’t charge 50 dollars for a plastic baggie that’s not worth 50 dollars in order to sell the marijuana.  It’s just not okay.”

Medina agrees, and doesn’t allow ‘gifting’ at his dispensary – and says violators will be banned…

“That’s truly not acceptable.”

Patridge agrees – and believes those requesting compensation for their gift could face charges…

“I believe it’s a violation.  I don’t believe the ‘wink and a nod’ is the appropriate way to do it.”

The Klamath County Commissioners are considering a ban on medical and recreational marijuana sales.

Hearings will be held at 9:15 on the mornings of September 8th, and the 22nd.

An evening meeting will be held September 15th at 6:pm, all meetings will be held at the Klamath County Government Center.
