Pepper spray punishment

(WKYC) Judge Michael Cicconetti has made headlines in the past for sentencing defendants to do everything from spending a night in the woods to holding up signs on the street corner.

Last Thursday’s sentences were just as unusual.

After spraying a person with mace at Burger King, defendant Diamond Gaston also got two options.

“He said either 30 days in jail or take a shot of mace to your face and I said I will just opt for the mace,” said Gaston.

But even the unusual judge Cicconetti knew he couldn’t make his punishment sting that much. The can had no mace, just water.

“I think it was the anticipation, the fear of it,” said Cicconetti. “Knowing or believing it was going to be pepper spray was enough to say ok.”

“He’s like ‘Oh it’s water’ and I’m like ‘Oh okay, that’s a relief’,” said Gaston.
