Wrongful death suit filed against former congressman

Medford, Ore. — The family of 58-year-old Jerry Hughes has filed a civil suit against the former United States Congressman Bob Smith.

Police said Smith struck and killed Hughes on the morning of February 8th in the crosswalk on Stewart Avenue and King’s Highway in Medford. The District Attorney’s Office said Smith will not face any charges due to a lack of evidence.

“The whole sentiment is we need to make Tina Hughes as whole as possible, and that’s going to be impossible with money but it’s the best we can do with our imperfect system,” Hughes’ family attorney, Shane Reed said.

Reed said they hope to settle the wrongful death case without going to court. Reed said Smith will have no control over whether or not his insurance company settles with the family.

They hope to reach a settlement within months, but it could take up to three years.
