Business Will Continue But With Restrictions

Jackson County is saying “not so fast” when it comes to the future of Mountain View Paving.

This just one day after a hearing’s officer said the plant was out of compliance and had to go.

It may have been a celebration too soon.

It’s been a near three battle between the city of Talent and a group calling themselves the Rogue Advocates, versus Mountain View Paving.

Talent and the Advocates wanted the asphalt company to move, they say the company is in a flood plain and generates too much noise and pollution for nearby residents.

Ahearing judge confirmed Mountain View Paving Company is in a flood plain and a reference was made to nearby residents.

However, according to the county the judge did not order Mountain View to move or cease as advocates had thought.

The decision is there are structures on the property that are lawfully non-conforming and therefore they can continue to function.

But she assures residents that the county will be monitoring the plant to make sure they are in compliance.

“If that are utalizing areas that are not approved,we will let them know if they have a violation and if they don’t correct it then we issue a citation and go through that process,” said Kelly Madding.

And if Mountain View Paving does not want to move the non conforming buildings, they can even appeal that.
