Pacific Power files lawsuit against Klamath Falls

Klamath Falls, Ore. – Pacific Power filed a federal lawsuit in District Court in Medford against the city of Klamath Falls Thursday.

Pacific Power claims a franchise ordinance passed by the city would limit compensation to Pacific Power…if the city decides to create a city-run electric utility.

Todd Andres of Pacific Power commented on the franchise ordinance: “Has a phrase in there that will limit just compensation if the city chose to do an eminent domain – so that gives us great concern.”

“We don’t really have a reaction to it.” Said Klamath Falls City Attorney Joanna Lyons-Antley. “We understood that shortly before it was filed that it was going to be filed, so we’re taking the time to look through it, and talk to our folks about what it might mean.”

The City Attorney says Klamath Falls is not considering formation of a municipal utility district at this time.
