After8 years of military service John Davis came home to Grants Pass and found a job as a route driver with Southern Oregon Sanitation
In 2001, Davis realized something was missing from his life.
“I think what made me really decide thatI wanted to join the National Guard was thatI missed the military,” Davis said.
Southern Oregon Sanitation received several awards and publicly stated how proud they were of Davis.
But 11 months after returning to work from his most recent deployment to Iraq, Davis was terminated and he says given no specific reasons.
“I had been working for the company for 12 years.I had never had any problems prior to my return of Iraq. AndI had mentioned to other people that i was being set up for failure.”
According to Davis’s attorney his termination is a clear a violation of the law.
“Congress in 1994 passed an act that guarantees the rights of our citizen soldiers to employment with their former employer,” said Robert Graham, Davis’ attorney.
Now Davis is suing his former employer stating the company made “unreasonable demands about the time required for competition of his route,” “making false allegations of davis causing accidents where there was damage,” “causing back dated false entries to be made in his personal file.” and several other allegations.
Davis filed a suit in the US District court Monday, seeking $208,000 for lost and future lost wages.
NBC 5reached out to Southern Oregon Sanitation and were told they would not comment on a pending lawsuit.
