The Oregon Supreme Court says it will be up to a jury trial now to decide whether Michael Cocchiara is entitled to compensation for being promised a job, but not getting it.
According to court documents, Cocchiara had a heart attack and was told by his doctor to find a less stressful job.
The documents said he was offered a position with the Mail Tribune, but declined it because Lithia officials said there was a new position available to suit his health needs.
However, court documents said Cocchiara was never hired for the job at Lithia.
