A battle between a Talent asphalt plant and an environmental group is once again brewing.
On Thursday the Rogue Advocates and the city of Talent both filed an appeal against Mountain View Paving Company.
Last month, a Jackson County hearing judge confirmed Mountain view paving company is in a flood plain and a reference was made to nearby residents and their health concerns.
However, according to the county, the judge did not order Mountain View to move or cease.
Instead a number of buildings are not able to be used.
The company has continued operations…
Now the case will be handed over to the Oregon Land Use Board of Appeals
